TERMS AND CONDITIONS Last Updated: 29.12.2025 1. INTRODUCTION Welcome to CamPose - AI Posing Assistant ("CamPose," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the CamPose mobile application and any related services (collectively, the "Service"). The Service is operated by Osman Yilmaz. By accessing or using CamPose, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. 2. PRIVACY POLICY Your privacy is important to us. Your access to and use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and share your personal information (including how we handle your photos and location data). By using CamPose, you acknowledge that you have read and understood our Privacy Policy. 3. AGE REQUIREMENT The Service is intended for users who are 13 years of age or older. By using the Service, you represent and warrant that you meet this age requirement. If you are a minor in your jurisdiction (usually under 18), you must have your parent or guardian’s permission to use the Service. 4. ACCOUNTS AND ANONYMITY Anonymous Access: An anonymous account is created for you immediately upon installation to facilitate usage. Registration: You may choose to register an account to save preferences or access specific features. You are responsible for maintaining the confidentiality of your account credentials. Termination: We reserve the right to suspend or terminate your account if you violate these Terms. 5. PROPRIETARY TECHNOLOGY & INTELLECTUAL PROPERTY The Algorithm: You acknowledge that the underlying technology of CamPose—specifically the real-time AI image alignment, sensor fusion data processing, and the "Cheese Mode" mechanics—is the proprietary intellectual property of CamPose. You may not reverse engineer, decompile, or attempt to derive the source code of the app. Ownership: All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code contained on the Service are owned, controlled, or licensed by or to CamPose. 6. SUBSCRIPTIONS AND PAYMENTS Subscription Plans: CamPose offers weekly, monthly, and yearly subscription plans ("PRO"). Free vs. PRO: Free Version: Includes ads, limited access to PoseMap scrolling, and limited export quality. PRO Version: Removes ads, provides extended daily scrolling limits on PoseMap, and unlocks full quality features. Billing & Renewal: Payments are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Cancellation: Deleting the app does not cancel your subscription. You must cancel via your phone’s settings (Apple ID or Google Play Account). Refunds: Refunds are handled exclusively by the respective App Store (Apple or Google) in accordance with their refund policies. 7. USER-GENERATED CONTENT (UGC) - "POSEMAP" Local Storage: By default, photos captured using the app are stored locally on your device. We do not access these photos unless you explicitly choose to upload them to "PoseMap." Real-Time Capture Only: To ensure authenticity, PoseMap only accepts photos captured in real-time via the App's camera at the specific location. Uploads from the device gallery are not supported. License to Use: By uploading a photo to PoseMap, you grant CamPose a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to display, reproduce, distribute, and modify that content within the Service. This license survives the termination of your account. PoseMap Uploads: If you upload a photo to PoseMap, you grant CamPose a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content within the Service for other users to view. Content Discretion & Moderation: All uploads are subject to pre-approval. We reserve the right, in our sole and absolute discretion, to review, refuse to post, remove, or edit any User Content for any reason, including but not limited to: Quality: Content that is low resolution, blurry, or aesthetically inconsistent with the Service. Relevance: Duplicate images from the same location or content unrelated to travel/photography. Safety: Strictly NO NSFW (Not Safe For Work) content. Pornography, violence, hate speech, or illegal acts are strictly prohibited and will result in an immediate ban. No Interaction: The Service allows users to view, like, or star content but does not support direct messaging or visiting other user profiles. Reporting Mechanism: If you encounter content on PoseMap that violates these Terms or is offensive, you may use the in-app "Report" button. Immediate Action: Upon reporting, the content will be immediately hidden from your view to ensure your safety and comfort. Review Process: Reported content is flagged for administrative review. We will evaluate the report and take appropriate action, which may include permanently removing the content from the Service and banning the offending user. 8. FAIR USAGE POLICY (ANTI-SCRAPING) To protect our community and server resources, we enforce limits on how much content can be viewed per day (PoseMap scrolling limits). PRO Limits: PRO users have a generous daily limit designed for human consumption. Bot Activity: Any automated scraping, data mining, or bot activity is strictly prohibited. If we detect usage patterns indicative of a bot (e.g., impossible scrolling speeds), we reserve the right to block access immediately without refund. 9. DISCLAIMERS AND COMPATIBILITY Hardware Requirements: CamPose utilizes advanced real-time algorithms involving heavy sensor and image data processing. We do not guarantee that the App will function on all devices. Device Compatibility: Some older or lower-specification devices may experience crashes, lag, or an inability to open the app. We are constantly working to optimize the app, but usage on unsupported devices is at your own risk. "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the alignment algorithm will work perfectly in all lighting conditions or environments. 10. THIRD-PARTY SERVICES The App uses third-party services to function, including Supabase (database), Sentry (analytics), RevenueCat (subscriptions), Google AdMob (ads), and Google Maps (location display). By using the App, you acknowledge that your data may be processed by these third parties in accordance with their own privacy policies. 11. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, CamPose shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service. 12. INDEMNIFICATION You agree to defend, indemnify, and hold harmless CamPose and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) your violation of these Terms, or c) your content posted on the PoseMap. 13. SEVERABILITY AND WAIVER If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. 14. GOVERNING LAW AND JURISDICTION These Terms shall be governed by and construed in accordance with the laws of Türkiye. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in Mersin, Türkiye. 15. CHANGES TO TERMS We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 day's notice prior to any new terms taking effect.
